Welcome to SUNDAYSQUARES.COM. This Terms of Use Agreement (the "Agreement") is a legally binding agreement between you (the "User") and SUNDAY SQUARES (the "Company"), a limited liability company located in the United States, governing the use of the SUNDAYSQUARES.COM website (the "Website") and any associated developer software development kits ("SDKs").

To ensure consistency between the use of the Website and the SDKs, the User agrees that all terms and conditions in this Agreement relating to the Website also apply to the SDKs.

The use of the Website is limited to individuals who are 18 years of age or older. By using the Website, you represent and warrant that you are at least 18 years of age.

The Company's Privacy Policy can be found here and is incorporated by reference into this Agreement.

   The Website and its contents, including but not limited to all text, graphics, logos, images, and software, are the property of the Company or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

2. Limited License

   The Company grants the User a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal or commercial use, subject to the terms and conditions of this Agreement.

3. Trademarks

   The Company reserves all rights in and to its trademarks, including but not limited to SUNDAYSQUARES.COM.

4. Copyright

   The Company reserves all rights in and to its copyrights, including but not limited to the content on the Website.

1. Acceptable Use

   You agree to use the Website only for lawful purposes and in accordance with this Agreement. You agree not to use the Website in any way that could damage, disable, overburden, or impair the Website or interfere with any other party's use of the Website.

2. Prohibited Activities

   You agree not to engage in any of the following activities:

   • Violating any applicable laws or regulations
   • Attempting to interfere with or disrupt the Website
   • Attempting to gain unauthorized access to the Website
   • Using the Website for any fraudulent or unlawful purpose

1. The Program

   Sunday Squares offers optional text message notifications about your account, including reminders that picks are about to lock in pools you have joined. The program sends account notifications only. It does not send marketing or promotional messages, and it does not offer or accept wagers.

2. Consent

   Text messages are off by default. By providing your mobile number and turning on text notifications, you agree to receive recurring automated text messages from Sunday Squares at that number. Consent is not a condition of purchase or of using the Website. You confirm that you are the subscriber or customary user of the number you provide, and you agree to update it if it changes.

3. Frequency and Cost

   Message frequency varies based on the pools you join and their pick deadlines. We do not charge for these messages, but message and data rates from your mobile carrier may apply.

4. Opting Out

   Reply STOP to any message to stop receiving texts. Reply HELP to any message for contact information. You may also turn off text notifications, or remove your number, on your Profile page at any time.

5. Delivery

   Message delivery depends on your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Text reminders are a convenience, and you remain responsible for making your own picks before the applicable deadline.

6. Availability

   The text message program is currently available to United States mobile numbers. Full program details are available on our Text Reminders page.

1. Governing Law

   This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

2. Dispute Resolution

   Any dispute arising from or relating to this Agreement shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

3. Class Action Waiver

   You agree to resolve any disputes on an individual basis and waive any right to pursue any claims on a class or consolidated basis.

1. Modifications

   We reserve the right to modify this Agreement at any time. Changes will be effective immediately upon posting to the Website. Your continued use of the Website following any changes constitutes your acceptance of such changes.

2. Severability

   If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
